Court orders CBI probe of minor dalit girl rape case

Shimla : The HP high court has issued notices to two police officials of the state government among others for delaying probe into the rape of a nine year old dalit girl and also ordered transfer of the case to the CBI, Thursday.

The girl from village Dhareen in Jwalamukhi is a student of class 5.In her petition filed through her mother alleged she was raped by Nitin Kumar on March 1 last year but the accused has not been arrested till date.

She claimed that the DNA test conducted by the state forensic science lab at Junga was not correct as the blood sample of some other person was allegedly sent for chemical analysis .

The victim was taken to Jwalamukhi government hospital the next day by the police but was referred to Dharamsala zonal hospital to a lady doctor.After this she was referred to Tanda mdeical college due to to her serious condition .

The accused was brought before her for identification but the victim could not identify him allegedly due to ill- health .

Later the victim identified the accused from his photograph shown to her by the CIA staff , but the police failed to arrest the acused as his DNA test was negative .

The petitioner also requested the court to obtain a DNA test of the accused through CBI afresh .

The petition also said that local people were angered by the incident and had staged a protest on the national highway and blocked traffic ten days after the incident.

They had been assured that the culprit would be arrested soon.But the police has failed to nab the culprit even after 18 months of the heinous crime .

The orders were passed by a division bench of the HP high court comprising Chief Justice Kurian Joseph and Justice Rajiv Sharma.
