New Delhi, April 8 (IANS) The fast track court hearing the Dec 16 Delhi gang-rape case Monday sought a response from Tihar Jail superintendent on an application of accused Akshay Thakur for transfer from Tihar Jail to Rohini Jail.
Counsel for accused Vinay Sharma and Thakur had moved applications saying his clients should be shifted from Tihar Jail to Rohini to ensure their safety.
Tihar superintendent Saturday filed a reply to Sharma’s application and opposed his plea.
Additional Sessions Judge Yogesh Khanna said: “Reply of jail superintendent on Vinay’s application stated that accused cannot be transferred from Tihar Jail to Rohini Jail as he was an adolescent. However, reply on Akshay Thakur’s application is not given. Let the jail superintendent file reply on Akshay’s application also,” said the court posting the matter for Tuesday.
The jail officer in the report submitted on Sharma’s application opposed the transfer of accused, saying: “Tihar Jail is meant for adolescent prisoners between the age of 18-21 years. As per the rule being an adolescent prisoner, Vinay cannot be transferred to Rohini Jail.”
On the allegations of Sharma that he was beaten up by the inmates in Tihar Jail, the court said it could not pass any order and the accused has to file a criminal complaint against inmates who had beaten him up.
“Accused (Vinay) is saying inmates beat him up and did not disclose their (inmates) names. In another statement, he said he fell down in police van. My power as sessions judge is to secure them. They can lodge FIR or criminal complaint against accused inmates. When you are not disclosing the names, what can be done?” said the court.
