Gang-rape accused refuses to return to ‘unsafe’ jail

New Delhi, April 6 (IANS) A Tihar Jail official Saturday denied in a Delhi court the allegation that Dec 16 gang-rape accused Vinay Sharma was beaten by inmates while the accused claimed threat to life and refused to return to prison after the hearing.

The jail official said Sharma’s right arm was fractured “due to a fall in police van while returning to jail from court”.

Amid high drama, Sharma, whose arm was bandaged, pleaded before Additional Session Judge Yogesh Khanna not to send him to Tihar jail after the court proceeding as he feared for his life.

“If you want to kill me, kill me here but don’t send me to Tihar in any condition,” said Sharma.

The court however did not concede his request and Sharma was taken to Tihar after the day’s proceeding.

His counsel claimed jail officials beat up his client in prison Friday night.

Superintendent of jail number 7 told the fast track court that Sharma informed him that the injury in his arm was due to a fall in the van April 4.

The jail official submitted a report and CD of CCTV footage of the barrack where Sharma was lodged and said Sharma “never said he was beaten up”.

“Vinay was personally questioned by the jail superintendent where he stated on record that the injury in his hand was due to fall in police bus on April 4 evening while returning from court and this has nothing to do with his stay in jail,” said the report.

“He also stated before me that he never told his counsel that he was beaten by the inmates of the jail…he stated that media reports are false and are being planned by certain people with an intention of receiving cheap publicity,” the report added.

The court reserved the order on an application which said that accused were being treated brutally in Tihar and they should be transferred to Rohini Jail.

The court will pass the order on the application Monday and directed the jail superintendent to look into the security of all the accused.

The judge Friday directed the jail superintendent to be personally present in the court and explain how accused Sharma fractured his hand and if any action had been taken on his allegations that he had been beaten up.

On Friday, Sharma arrived in court with a fractured hand and his counsel said jail inmates and police beat him up as he wanted to appear for an Indian Air Force (IAF) recruitment exam.

The jail report said: “Statements of all co-accused of his barrack has been recorded and CCTV footage of the night of April 4 was examined to find out whether he had any fight with anybody or whether anybody harmed him in the jail but no such instance was noticed.”

The report also said that April 4 around 6.30 p.m. Vinay had complained of chest pain and vomiting, he was taken to Deen Dayal Upadhyay hospital.

“At DDU hospital, he was medically checked up for chest pain and vomiting and thereafter he denied all the previous complaints and claimed of pain in the right elbow. He was referred to the orthopedic emergency,” the report added.

“At Orthopedic emergency he has told the doctor that he fell in the jail van,” the report said.

The jail authority said that the allegations levelled by Sharma that he was beaten up were false.

“In the light of the contradictory statements of the patient prisoner in various hospitals, the allegations levelled in the application are totally false, mischievous and unfounded for ulterior motive,” said the report.

The Tihar jail official opposed the application of Sharma seeking transfer to Rohini jail.

Counsel for co-accused Pawan Gupta said that his client did not want to be transferred to Rohini jail.
