Himachal Consumer Forum Awards Rs 18-39 Lakh In Settling 154 Cases

Shimla: District Consumer Disputes Redressal Forum, Shimla settled as many as 154 consumer complaints in July whereby compensation of Rs. 18.39 lakh was awarded. Those who had defaulted in implementing the forums orders were asked to pay litigation costs of Rs 35,000, a spokesman for the consumer forum stated.

Giving out the details, Sureshwar Thakur, chairman of the forum said that of the 154 complaints disposed off, 94 complaints pertained to Shimla District, 52 to Solan district and 8 complaints were from Sirmaur district.

Some of the cases settled were six years old complaints, he said. In Shimla district, 3 complaints disposed were from the year 2003, 5 from 2004, 16 from 2005, 17 from 2006, 24 from 2007, 12 from 2008 and 16 from 2009.  In Solan district 4 settled were from 2005, 11 from 2006, 16 from 2007, 15 from 2008 and 6 from 2009, he said.

  1. I must congratulate the author for this news as the District Fora in Himachal Pradesh are not that fast in disposing cases as other fora in the country.

    It is mandatory for the Fora to settle each case within six months but here it takes years.One of my own case has been decided by the DF on 30 MAY 03, then it went to the State Commission and the National Commission.
    Finally I filed the Execution application No: 33/06.
    This simple execution application in this case which was titled as P S Sawhney vs. HIMUDA has been draging for the last 03 years. Every time I had to travel from Chandigarh to Shimla at this ripe age of 70+.
    Now it is listed for orders on 25th instant. I wonder,if you can help me in procuring a copy of the order.

  2. Many thanks for posting my comments. The Ld. DF has there after mounted the orders/judgment on its site.The appeal to the same cannot be filed without the signed copy of the original order/judgments; still I have downloaded the judgment/order.My since thanks to the Hon’ble President of the DF and to My Himachal.
    Unfortunately many errors of fact have crept in.The most glaring being my presence recorded by the Ld.DF on the 25 NOV 09, when I was not there.The follows the fact that both the advocates undertook to collect copies of the order/judgment.Firstly I had never engaged any advocate so there is no question of giving such an undertaking.
    My predicament now is that I cannot file the appeal without the copy of the signed order, to which I am entitled to, free of charge.
    For getting the copies of all the JIMNI orders i.e order sheet from date to date of the DF, I did remit the amount of Rs.100/- by Crossed IPO Bearing No. 22H 039246,on the 30 ultimo with a written request, that too by Speed Post. Even the 30 days time under the RTI Act 2005, shall be expiring soon.
    The same is yet to reach me.
    Pl. help me to get the same,if you can?

  3. After perusing the order/judgment of the Ld. DF I am of the confirmed view that every judicial proceeding shall be video graphed.
    This will be boon to both the parties before the court: since a replay of the video will work as a permanent record of proceedings for any back reference.
    Not only that such records will be of much help to the courts of Appeal in knowing the pleaded facts and law. Backing out by unfaithful will be totally out of question.
    The cost involved will be not much in terms of the results which these recordings will provide to the litigating parties. The superior courts will also come to know,if justice has been done.Justice is not only to be done but it has to seen to be done.
    This confirmed opinion is based upon my first hand experience of more than 28 years with District , State and National Consumer Fora and various High Courts & the Hon’ble Supreme Court of India.

    Awareness of Consumer Forum among Indian citizen are increasing, even our Govt. is also moving forward by the help of some NGO’s like National Consumer Helpline, Core Center, Consumer Voice and many other. But still Consumer Forums have very limited power as its a Tribunal.

    It is almost a year that the state commission is without its president.Plenty of cases are pending with the state commission.This is to request the Hon’ble Minister of Civil Suppllies to fill up the post so that no further backlog is created.
