Himachal High Court Stays Pollution Notice To Hotel Wildflower Hall

Shimla: The Himachal High Court today stayed a notice of the State Pollution Control Board wherein the board had threatened to disconnect the electricity supply to Five Star Hotel Oberoi Wildflower Hall over violation of pollution norms that were allegedly causing water and air pollution.
A division bench consisting of Justice RB Mishra and Justice VK Ahuja issued notice to the state government and pollution control board, directing them to file a reply within four weeks.
The case is now scheduled to come up for hearing after four weeks.
Mashobra Resort Company, owner of Wildflower Hall, in its petition today pleaded before the court that a sewerage treatment plant, equipped with latest technology, was installed at the hotel site.
The petitioners argued that the pollution control board had not given a 15 days’ notice to them as was required under the act.
HP Pollution Control Board had served a notice on Mashobra Resort Company on 24 May, 2010 that water being discharged from the hotels sewerage treatment plant was polluting water sources downstream.
The board had granted a week’s time for filing a reply and had threatened to disconnect the hotels power supply, should the management be unable to muster a satisfactory explanation.

Clearly shows how weak the government departments are!
If there is an act to give 15 days notice, why that rule was bot followed by pollution control department?
Why they acted after he whole stream was already destroyed for many weeks/months?
It is usual pathetic situation of govt departments building loose cases.
